Welcome to Navia Energy (“Navia”, “we”, “our”, or “us”). These Terms of Service (“Terms”) govern your access to and use of the Navia Energy mobile application and related services (“the App”). By downloading or using the App, you agree to be bound by these Terms. If you do not agree, please discontinue use of the App.

1. Use of the App

You must be at least 13 years old (or the minimum age allowed in your region) to use the App. By using the App, you confirm that you meet this age requirement and have the legal capacity to enter into these Terms.

1.1 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.

1.2 Restrictions

You agree not to:

  • Modify, distribute, or reverse-engineer the App
  • Use the App for unlawful, harmful, or deceptive purposes
  • Interfere with the App’s security or the operation of connected devices
  • Access the App using automated tools except through authorized APIs

2. Account Requirements

Some features may require an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities performed using your account.

You agree to notify us immediately if you suspect unauthorized access to your account.

3. Smart Plug Control & Connected Devices

The App enables the control and monitoring of compatible smart plug devices. By using the App, you acknowledge the following:

  • The App’s functionality depends on third-party devices and network connectivity.
  • We are not responsible for damage caused by misuse, hardware malfunction, or improper configuration of smart plugs or other connected devices.
  • You agree to use connected devices safely and in accordance with manufacturer guidelines.

4. Energy Usage Data and Analytics

The App may display real-time and historical energy usage data. You understand and agree that:

  • Energy data may vary depending on device accuracy.
  • Analytics and insights are informational only and are not guarantees of energy savings.
  • We are not liable for decisions made based on energy statistics or estimates.

5. Updates and Changes

We may release updates, patches, or new versions of the App. These updates may be required for continued use. We reserve the right to modify or discontinue features or the App at any time without notice.

6. Third-Party Services and Links

The App may integrate with or link to third-party devices, services, or platforms. We do not control these third parties and are not responsible for their content, performance, or privacy practices. Your use of any third-party service is governed by that party’s terms.

7. Intellectual Property

The App, including its design, text, graphics, software, and trademarks, is the property of Navia Energy or its licensors. You may not use our intellectual property without prior written permission, except as permitted by applicable law.

8. User Conduct

You agree to use the App responsibly and not engage in activities that could:

  • Disrupt service for other users
  • Infringe on the rights of others
  • Compromise the security or integrity of the App
  • Violate applicable laws or regulations

9. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if we believe you have violated these Terms or if necessary for operational or legal reasons.

Upon termination, your license to use the App will immediately end.

10. Disclaimer of Warranties

The App is provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Availability, accuracy, or reliability of the App

We do not guarantee uninterrupted or error-free operation of the App.

11. Limitation of Liability

To the maximum extent permitted by law, Navia Energy is not liable for:

  • Indirect, incidental, or consequential damages
  • Loss of data, profit, or business opportunities
  • Damage resulting from smart plug misuse or third-party device failures
  • Unauthorized access to your account or data

Our total liability for any claim arising out of or relating to the App will not exceed the amount you paid for using the App (if any), or $25 USD, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless Navia Energy and its affiliates from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

13. Governing Law

These Terms are governed by the laws of your country or state of residence, unless otherwise required by applicable law. Any disputes will be resolved in the courts of the relevant jurisdiction.

14. Changes to These Terms

We may update these Terms periodically. The “Last updated” date at the top reflects the most recent version. Continued use of the App after changes means you accept the updated Terms.
